ORDINANCE NO. 92-060'" WHEREAS, Deschutes County's adopted comprehensive pl'arn map and zoning maps were contemporaneously acknowledged as compl�Vingr�with Oregon's statewide land use planning goals; and 0119w1742 WHEREAS, the Board of County Commissioners finds that it was intended as part of the County's acknowledgement that the comprehensive plan map reflect and be consistent with certain zoning designations on the acknowledged zoning map; and WHEREAS, due to an oversight those maps are not now internally consistent and it is desirable that the County's Plan, including the zoning maps, be internally consistent; and WHEREAS, a public hearing has been held in furtherance of this objective in conformance with state law before the Deschutes County Planning Commission and the Board of County Commissioners for Deschutes County; and WHEREAS, the Board of County Commissioners has considered the recommendations of the Planning Commission and the public; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDAINS AS FOLLOWS: Section 1. ADOPTION OF MAP. The 1979 Comprehensive Plan Map, shown as Exhibit A, attached hereto, as amended, is further amended to add to the Rural Residential Area designations shown thereon those expanded and additional Rural Residential Exception Areas shown on a map entitled "Ordinance 92-060 RR -10 Areas and MUA-10 Areas," dated November 25, 1992, and attached hereto as Exhibit B and by this reference incorporated herein. Section 2. FINDINGS. The Board of County Commissioners adopts as its findings and conclusions in support of this amendment the findings attached as Exhibit "C" by this reference incorporated herein. Section 3. SEVERABILITY. The provisions of this ordinance are severable. If any section, sentence, clause, phrase, area, overlay or other separable, separate or distinct part of this ordinance or any exhibit thereto is adjudged to be invalid by a reviewing body of PAGE 1 - ORDINANCE NO. 92-060 (11/25/92) CHEF 3 1992 i;; 0119--1744 competent jurisdiction, that decision shall not affect the validity of the remaining portions of this ordinance or any exhibit thereto. Section 4. REPEAL OF ORDINANCES AS AFFECTING EXISTING LIABILITIES. The repeal, express or implied, of any ordinance, ordinance provision, or code section by this ordinance shall not release or extinguish any duty, condition, penalty, forfeiture, or liability incurred under such ordinance, unless a provision of this ordinance shall so expressly provide, and such ordinance repealed shall be treated as still remaining in force for the purpose of sustaining any proper action or prosecution for the enforcement of such duty, condition, penalty, forfeiture, or liability, and for the purpose of authorizing the prosecution, conviction and punishment of the person or persons who violated the repealed ordinance. Section 5. EMERGENCY. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. BOARD OF/COUNTY COMMISSIONERS OF DESC�H TES COUNTY, OREGON HROOPU /Co)nmiss ME�f l�"(JJV,!MJ - - i• , r PAGE 2 - ORDINANCE NO. 92-060 (11/25/92) EXHIBIT C 0119-1745 FINDINGS FOR ADOPTION OF RURAL RESIDENTIAL CHANGES TO THE COUNTY COMPREHENSIVE PLAN As part of the County's periodic review the County Comprehensive Plan Map is being updated. The initial County Comprehensive Plan Map was adopted by the Board of County Commissioners on November 1, 1979. The Comprehensive Plan Map was a general map which did not included all specifics shown on the County Zoning Maps. The subject map update is to include the specifics left off of the original Comprehensive Plan Map. Some areas zoned Rural Residential (RR -10) and Multiple Use Agriculture (MUA-10) were not shown on the original Comprehensive Plan Map. The reasons outlined below provide findings for the subject map update. 1. Page 149 of the County Comprehensive Plan states: "Comprehensive Plan Maps show generally how various uses will be allocated throughout the jurisdiction, but the zoning map takes this general prescription and specifically identifies how each individual piece of property is to be zoned." 2. The County Comprehensive Plan Map contains some but not all exception areas designating such areas Rural Residential. Documentation in the findings of the Board of County Commissioners, in support of the adoption of the County Comprehensive Plan for acknowledgement, in 1981, indicate that areas were not mapped on the Comprehensive Plan Map because they were too small for the scale of the map. The Zoning Maps were intended to refine the Comprehensive Plan Maps to specifically designate Rural Residential areas. 3. The subject map update was accomplished using digital scanning of all county Zoning Maps. The subject Comprehensive Plan Map is essentially an electronic picture of the zoning maps. This new technology allows more precise mapping of exception areas at the scale of the Comprehensive Plan than was possible when the original map was created. The new Comprehensive Plan Map was compared to the original Zoning Maps by overlaying each area of the county to ensure consistency with the original Zoning Maps. The Board finds this to be an accurate methodology to ensure consistency between the original Zoning Maps and the Comprehensive Plan. 4. The Comprehensive Plan Map, Text and Zoning Maps were adopted contemporaneously and are an integrated part of the package acknowledged by LCDC in 1981. The Board of County Commissioners finds that the original acknowledgement record for the County's Comprehensive Plan, supports conclusions that the zoning maps were acknowledged as part of the County's Comprehensive Plan and therefore are consistent with the County Comprehensive Plan.
